BOCC Action for Aug. 22, 2022
RNR for Johnson County Taxing District
Conducted a public hearing on the proposed FY 2023 Budget to exceed the revenue neutral rate and adopted Resolution No. 051-22 authorizing a levy of property taxes in support of the budget for the Johnson County Taxing District, for the FY 2023 budget year that requires a property tax rate exceeding the revenue neutral rate of 16.841 mills. Vote: Passed 5-2.

RNR for Park and Recreation Taxing District
Conducted a public hearing on the proposed FY 2023 Budget to exceed the revenue neutral rate and adopted Resolution No. 052-22 authorizing a levy of property taxes in support of the budget for the Johnson County Park and Recreation Taxing District for the FY 2023 budget year that requires a property tax rate exceeding the revenue neutral rate of 2.809 mills. Vote: Passed 5-2.

National Breastfeeding Month
The Board issued a proclamation declaring August as National Breastfeeding Month. Chelsie Todd-Deneault, WIC dietitian from the Department of Health and Environment, accepted the proclamation.
Leadership in Action recipients
County Manager Penny Postoak Ferguson introduced four county employees as recipients of Leadership in Action Awards for Board recognition along with a video of the honorees. They are Kate Clark and Jennifer Lowe, both with Health and Environment; Janice Phillips, Facilities; and Jennifer Barnes, Park and Recreation District. View the video.

BOCC Action for Aug. 25, 2022
Granted request for drainage easement
Granted a drainage easement at the southwest corner of the Douglas L. Smith Middle Basin Wastewater Treatment Plant property, as described in Attachment A, to the Kansas Department of Transportation. Vote: Passed 7-0.
Authorized Corrections to submit carryover reimbursement budget
Authorized the submission of the Johnson County Department of Corrections’ State FY2023 Carryover Reimbursement Budget to the Kansas Department of Corrections as recommended by the Community Corrections Advisory Board in the amount of $179,872.07. Vote: Passed 7-0.
Reappointed Pamela Shernuk to Commission on Aging
Approved the reappointment of Pamela Shernuk – Third District Representative to the Commission on Aging through Aug. 31, 2025. Vote: Passed 7-0.
Held hearing on Fire District No. 2’s proposed budget exceeding RNR
Sitting as the Governing Board of Fire District No. 2 and conducting a public hearing on the proposed budget and to exceed the revenue neutral rate, adopted Resolution No. 2022-1 authorizing a levy of property taxes in support of the budget for Fire District No. 2 for the Fiscal Year (FY) 2023 budget year that requires a property tax rate exceeding the revenue neutral rate of 14.361 mills for the Fire District No. 2 General Fund, 0.778 mills for the Fire District No. 2 Debt Service Bond H Fund, and 0.000 mills for the Fire District No. 2 Debt Service Bond I Fund. Vote: Passed 7-0.
Approved Fire District’s 2’s proposed budget
Sitting as the Governing Board of Fire District No. 2, approved and adopted Resolution No. 2022-2 to approve the Fiscal Year (FY) 2023 budget for Johnson County Fire District No. 2 as proposed. Vote: Passed 7-0.
Held hearing on funding for lagoon cleanout program
Conducted a public hearing and approved Resolution No. WD 22-025 to authorize funding for the Lagoon Biosolids Cleanout Program in an amount not to exceed $528,900, increasing the total project authorization to $2,285,100. Vote: Passed 7-0.
Approved agreement for wet weather storage site
Conducted a public hearing and approved Resolution No. WD 22-026 to authorize funding in the amount of $100,000 and authorized the Chairman to execute the “Real Estate Agreement” for the purchase of property from the Parks and Recreation Foundation of Johnson County within the City of Shawnee for future use as a Johnson County Wastewater wet weather storage facility site. Vote: Passed 7-0.
Authorized funding increase for software licenses
Authorized an increase in the amount of $119,785.28, for an annual amount not to exceed $1,165,467, for Government Cloud Microsoft Enterprise Agreement with Dell Technologies for the purchase of SQL Server Software Licenses related to the Orion Land Records application per IFB 2022-010. Vote: Passed 7-0.
Transferred federal allocation to General Fund reserves
Authorized the allocation of Coronavirus SLFRF received from the United States Department of the Treasury in the amount of $40,936,600, including $400,000 in additional interest earnings, and $40,536,600 in lost revenue, as determined for fiscal years 2020 and 2021, in accordance with the Treasury’s prescribed formula, authorized the transfer of the $40,536,600 to the Countywide Support Fund (CSF), and authorized the reallocation and expenditure of General Fund reserves for Fiscal Year (FY) 2022, in an amount not to exceed $40,936,600. Vote: Passed 7-0.

In spotlighting a Johnson County Department/Agency program to share both successes and/or challenges being faced in the organization, Criminal Justice Coordinator Mike Brouwer highlighted the Criminal Justice Advisory Council with a presentation to the Board and responded to questions from the Board. Public Works director provides 199th Street truck traffic update
Brian Pietig, director of Johnson County Public Works, provided an update on steps the county is taking to address the 199th Street truck traffic. View his memo.
Merriam has public hearing on project
The City of Merriam conducted a public hearing on Monday, Aug. 22, to consider approving a property tax abatement project. The proposed project is to be financed with $93 million in industrial revenue bonds for acquiring and constructing two multi-family residential buildings and improvements, including structure parking facilities and related infrastructure, to be located at approximately the southwest corner of Shawnee Mission Parkway and Antioch Road. The applicant has requested a 10-year, 100% property tax abatement with a payment in lieu of taxes of $24,741 per year. View a copy of the cost-benefit analysis and notice.

Contracts for bypass pumping services

Consider authorizing term and supply contracts with Velocity Pump Rental and Sunbelt Rentals, Inc. for wastewater temporary bypass pumping services for Johnson County Wastewater in a total annual amount not to exceed $250,000 with the option to renew annually for up to four (4) additional 12-month periods.
Funding, contract for BikeWalk KC
Consider accepting funding from Kansas Department of Transportation (KDOT) in the amount of $152,000, increasing the total project amount to $190,000, and authorize contract renewal one (1) with BikeWalk KC in the amount not to exceed $190,000 from December 27, 2022, to December 26, 2023, per RFP 2021-055, to continue the Safe Routes to School Program.
Funding for COPE project
Consider accepting funding and increasing budget authority in an amount not to exceed $180,578 for the period between June 1, 2022, and May 31, 2023, for the Johnson County Department of Health and Environment (JCDHE) to continue the Communities Organizing to Promote Equity (COPE) project.
Funding for HHW capital project
Consider approving and authorizing an increase of $610,000 for the Household Hazardous Waste (HHW) Facility capital project bringing the new total project authorization to an amount not to exceed $3,628,000 and the reallocation and use of Fiscal Year (FY) 2022 General Fund reserves in the amount of $1,610,000 to transfer to the Public Building (PBC) Commission for the Household Hazardous Waste (HHW) Facility capital project.
Increased expenditure authority for contracts
Consider authorizing an increase to expenditure authority for term and supply contracts with KBS Constructors, Inc., Kelly Construction Group, Inc., B.A. Green Construction Co., Inc., and Universal Construction Co. for On-Call Construction Services, in the amount of $610,000 for a total contract value not to exceed $7,610,000. The current contract term is through December 15, 2022, with four (4) additional one (1) year renewal options available, per Request for Proposal (RFP) 2021-053.
