BOCC Action for Dec. 1, 2022
Plats for Morgan Acres
Approved Application No. SW 22-254-PP/FP (MC) from Wayne Malnicof, applicant, and Dale and Tammy Morgan, landowners, requesting a preliminary and final plat for two residential lots on approximately 40.2 acres, to be known as Morgan Acres, on property zoned RUR, Rural District, located at the southwest corner of 167th Street and Evening Star Road, Section 23, Township 14, Range 21. Vote: Passed 7-0.
Permit for earth excavation operation
Approved Resolution No. 094-22 and Application No. SE 22-242-CUP (AU) regarding a request from Tim Tucker, Phelps Engineering, Inc., applicant, on behalf of Fred Kibler of Anna Louise Briggs Trust landowner, for a Conditional Use Permit with a 3-year term, for an earth excavation and filling operation at 2600 199th Street, on eight acres of the total 159.29 acres and zoned RUR, Rural District. Vote: Passed 7-0.
Permit for accessory structures
Approved Resolution No. 095-22 and Application No. SW 22-253-CUP (GA) regarding a request from Tony and Kathleen Black, applicant and landowners, for a Conditional Use Permit with a term of 20 years to allow a total of four accessory structures on the property, on 8.7 acres, zoned RUR, Rural District, located at 26125 W. 207th Street. Vote: Passed 7-0.
Plan for airplane hangar
Approved Resolution No. 096-22 and Application No. SW 22-255-FDP (GA) regarding a request from Brian Weber, Nexus 5 Group, on behalf of Jeffrey Altendorf, Plane Hangar LLC, applicant, and Johnson County Airport Commission, landowner, requesting a Final Development Plan for construction of an airplane hangar on 1.4 acres, on property zoned PEC-3, Planned Research, Development and Light Industrial Park District, located at 570 Highland Drive, New Century AirCenter. Vote: Passed 7-0.
Fire district’s 2021 year-end statements
Sitting as the Governing Body of Fire District No. 2, accepted the Audited Financial Statements for the year ending Dec. 31, 2021. Vote: Passed 7-0.
Updated stormwater standards
Approved an agreement with the Mid-America Regional Council to update and improve regional stormwater management standards and planning guidelines, in an amount not to exceed $350,000. Vote: Passed 5-2.

CERI releases November edition of economic indicators
The November 2022 edition of economic indicators for Johnson County has been provided by County Economic Research Institute (CERI). The report noted decreases in unemployment rates, sales of single-family homes and total number of single-family building permits issued. Additionally, CERI reported an increase in total retail sales for Johnson County. View the full report.

This report is for major projects over $1 million and master plans. The report is provided bimonthly and supplements the Public Building Commission biannual reports in February and August. The information contained in this report is through Nov. 23, 2022. View a copy of the report.
Planning staff inspects Sunflower Quarry
A conditional use permit (CUP) was approved by the BOCC in 2020 for Sunflower Quarry. The CUP included a stipulation for planning staff to inspect the property annually during the term of the CUP and to prepare a report for the BOCC. Planning staff conducted an inspection of the Sunflower Quarry on Oct. 21, 2022. View a summary memo of the inspection. The memo had favorable findings from the inspection.
Olathe plans hearing on TIF for BCB Olathe Holdings
The City of Olathe will be conducting a public hearing on Tuesday, Dec. 6, to consider approving a property tax abatement in connection to property financed with approximately $30 million in industrial revenue bonds for BCB Olathe Holdings, LLC. The project is located at the intersection of South Fountain Dr. and West Frontier Lane. View the notice of public hearing along with the cost benefit analysis.

Amendment to action plan to accept ARP grant funds
Resolution No. 100-22. Hold a public hearing and consider approving an amendment to Resolution No. 077-20 and to approve a substantial amendment to the 2021 Annual Action Plan to accept an additional $3,977,106 of American Rescue Plan grant funds administered by the Home Investment Partnerships (HOME-ARP) program from the United States Department of Housing & Urban Development.
Construction phase services at wastewater project
Consider authorizing a contract amendment with McCarthy Building Companies, Inc., for Guaranteed Maximum Price Number 3 – Nelson Site Preparation, for Construction Manager at Risk construction phase services for the Nelson Wastewater Treatment Facility Improvements project (NEL-C001) in an amount not to exceed $17,586,400 increasing the total construction phase services authorization to $23,642,208; and consider authorizing a contract amendment with Black & Veatch Corporation for Guaranteed Maximum Price Number 3 construction phase services, in an amount not to exceed $1,793,600, increasing the total engineering authorization to $39,766,600.
Agreement with Mission for wastewater project
Consider approving an Intergovernmental Agreement with the City of Mission to facilitate the Nelson Wastewater Treatment Facility Improvements Project.
Mental Health agreement with MyAvatar Cloud
Consider approving an exception to competition and authorizing Mental Health staff to sign an agreement with Netsmart Technologies, Inc. for MyAvatar Cloud Hosting Services in an amount not to exceed $225,000 annually and a one-time setup cost of $78,360 per Administrative Policy and Procedure #110.180.A.16.
Reallocation and use of funds
Consider authorizing the reallocation and use of Fiscal Year (FY) 2018 Major Asset Replacement Program (MARP) remaining funds of $1,490,000 for Interior Improvements project at Elections Office, 2101 E Kansas City Rd., and an Asset Maintenance Allowance for existing Human Services Building (HSB), 11875 S. Sunset Drive and Olathe Mental Health Office, 1125 W Spruce, located in Olathe.

Consider approving the 2023 Audit Plan proposed by the County Auditor.
Prohibition of truck traffic on certain county roads
