BOCC Action for June 15, 2023

Reconsideration of Habitat project funding

Motion made for Board to reconsider its authorization on June 8, 2023 for the allocation of Coronavirus SLFRF received from the U.S. Department of the Treasury in the amount of $950,000 for the purpose of funding community investment of infrastructure costs for Habitat for Humanity’s Olathe Pathway Project. Vote: Failed 2-5.

Agreement renewal for respite care services

Authorized an exception to competition and approved a service agreement renewal for respite care services with DCCCA, Inc., in an amount not to exceed $100,000, for one additional 12-month contract period ending June 30, 2024 per Administrative Policy and Procedure #110.180.A.16. Vote: Passed 7-0.

Contract for pond sediment removal

Authorized a contract (IFB No. 2023-024) with Phillips Site Work, Inc. for the NCADC Pond Sediment Removal and Disposal Project located at 27745 W. 159th St., New Century, in the amount of $329,175.78. Vote: Passed 7-0.

Contract for School Food Service Management Program

Authorized a contract (RFP No. 2023-010) with Trinity Services Group, Inc., for a School Food Service Management Program, at a cost not to exceed $316,000 for a period of one year with the option to renew for an additional four one-year renewal periods. Vote: Passed 7-0.

Consolidation of two zoning boards

After a public hearing, adopted Resolution No. 046-23 to consolidate the Northwest and Southwest Consolidated Zoning Boards into the West Consolidated Zoning Board and establish the qualifications and appointment process of members to the West Consolidated Zoning Board. Vote: Passed 7-0.

Renaming of zoning board

Adopted Resolution No. 047-23 to rename the Southeast Consolidated Zoning Board to the East Consolidated Zoning Board and establish the qualifications and an appointment process of members to the East Consolidated Zoning Board.

Motion made to amend motion to have the 3rd District Board member nominate five members instead of four and the Chair of the Board to nominate two members instead of three to the East Consolidated Zoning Board all of whom shall be voted on and appointed by a majority vote of the Board. Vote: Failed 2-5.

Establishing appointment process to planning commission

Adopted Resolution No. 045-23 to establish the qualifications and appointment process of members to the Johnson County Planning Commission. Vote: Passed 7-0.

Shawnee plans hearing on proposed development project plan

The City of Shawnee will be conducting a public hearing at 6 p.m. Monday, June 26, to consider the adoption of the proposed redevelopment project plan for a project area in the Hickok Zarah redevelopment district in Shawnee. A copy of the public notice is attached here.

Other Reports

In other reports from the County Manager Penny Postoak Ferguson’s weekly memo, Johnson County Housing Coordinator Megan Foreman; Lee Jost, minister and executive director at NCircle; and Joe Karin of Karlin Consulting LLC and Lenexa City Council presented the Dignity Project Feasibility Study. The study details affordable and accessible rental housing needs, a shortage of landlords willing to accept Housing Vouchers and a need for an emergency shelter regarding homelessness in Johnson County. A final report is expected in July.

Easements for proposed pump station

Consider executing an “Easement Purchase Agreement” in the amount of $309,020 for the acquisition of easements within the City of Leawood for a proposed pump station as part of the State Line Road Pump Stations and Force Main Project (LWC-Contract 6).

Installation of fiber optic lines

Consider authorizing the Wastewater General Manager to execute an agreement with K&W Underground, Inc. to install fiber optic lines through the Nelson Wastewater Treatment Facility, in an amount not to exceed $175,000, per the City of Olathe Agreement No. 21-0102.

Revised policy on equal job opportunity

Resolution No. 049-23. Consider adopting revised Human Resource Policy 105 pertaining to equal opportunity in employment to be effective June 22, 2023.

Lease amendment for Gardner Multi Service Center

Consider executing a lease amendment with Buckley Properties, a Limited Liability Company, to extend the term five years for the Gardner Multi Service Center at 510 W Main, Gardner, for an amount of $39,600 per year.

Contract for paving project at Sunset Office Building

IFB #2023-014 Consider authorizing a contract with Phillips Site Work, Inc. for the Sunset Paving Repairs and Replacement – Phase 1 Project at the Sunset Drive Office Building, located at 11811 S. Sunset Dr., Olathe, in the amount of $142,307.15.

Contract for paving project at Northeast Office

IFB #2023-013 Consider authorizing a contract with R&R Concrete, Inc. for the Northeast Office Paving Repairs and Replacement – Phase 1 Project located at 6000 Lamar Ave., Mission, in the amount not to exceed $524,580.

Rezoning and plats for Steele Waters

Resolution No. 042-23 and Resolution No. 043-23. Application Nos. SW 23-282-REZ (GA) and SW 23-275-PP/FP (GA). Consider a request from Matt Cox of AllenbrandDrews, applicant, on behalf of Thomas and Shawnna Steele and Clifton and Jacqueline Bencke, landowners, for a Rezoning from PRU1B and RUR to PRU1B, Preliminary and Final Plat, which shall serve as the Preliminary and Final Development Plans, seven plat exceptions, and one Minimum Infrastructure waiver for a three-lot residential lot to be known as Steele Waters, located at 15236, 15240 and 15250 Lake Road 12 Street, Gardner Township.

Final plat for Mulberry Hill Estates

Application No. SW 23-290-FP (GA). Consider a request from Jay O’Dell, Aubry Enterprises, applicant, and Dale Klaasmeyer, Klaasmeyer, LLC, landowner, for a Final Plat for 12 residential lots to be known as Mulberry Hill Estates, Second Plat, on approximately 27-acres, on property zoned RN-2, Residential Neighborhood Two District, located on the northeast corner of Gardner Road and 151st Street.

Resolution No. 041-23. Application No. SW 23-292-PP/FP (GA). Chris Eakin with Eakin Co, applicant, and Wayne and Cheryl Schweizer, landowner, are requesting a Preliminary Plat and Final Plat, which shall serve as the Preliminary and Final Development Plans, and a Minimum Infrastructure Waiver to not construct 152nd Street to a Type “B” Collector Street Standard, for one residential lot, to be known as Schweizer Cove, on a 20,800-square-foot lot zoned PRU-1B, Planned Residential Urban Single Family 1B District, located at 29235 W. 152nd Street, Gardner Township.

Resolution No. 044-23. Application No. SW-23-291-FDP. Consider a request from VanTrust Real Estate Development, LLC, applicant, and Johnson County, landowner, for a Final Development Plan for Building B2, for the New Century Commerce Center, on 18.66 acres, zoned PEC-LP, Logistics Park District, located in the vicinity of 165th Street and Clare Road.

Amendments to Rural Comprehensive Plan

Resolution No. 048-23. Consider adopting Resolution No. 048-23, recommending certain amendments to the Johnson County Rural Comprehensive Plan, relating to future land use updates and changes regarding the Policy Area Map and the County’s Area Plans, including the 1998 Sunflower Army Ammunition Plant Concept Plan.

Purchase of property for wet weather storage site

Resolution No. WD 23-015. Conduct a public hearing and consider authorizing funding in the amount of $313,825 and consider authorizing the Chairman to execute the proposed “Real Estate Sale Contract” for the purchase of property within the City of Merriam for future use as a Johnson County Wastewater wet weather storage site and any other documents required for the authorized purchase.

Adoption of policies about certain employee benefits

Resolution No. 050-23. Consider adopting revised Human Resource Policies 503, 504, 505, and 508 pertaining to certain employee benefits to be effective June 22, 2023.
