BOCC Action for Oct. 6, 2022

Appointments to two commissions

Approved appointments of Janine Estrada-Lopez as the Fourth District representative to the Tenth Judicial District Nominating Commission through March 4, 2024, and Charles W. McAllister Jr. as the Fifth District representative to the Commission on Aging through Aug. 31, 2024. Vote: Passed 7-0.

Reappointments to five commissions or boards

Approved reappointments of Andrea Leavitt as the First District representative to the Commission on Aging through Aug. 31, 2025; Debbie Scott Williams as the Second District representative to the Developmental Supports Board through Aug. 31, 2025; Carol Lehman as the Fourth District representative to the Airport Commission through July 31, 2025; Mark Burdolski as the Sixth District representative to the Fire District No. 1 Governing Board through July 1, 2025; and  Gayle V. Richardson as the Seventh District representative to the Developmental Supports Board through Aug. 31, 2025. Vote: Passed 7-0.

Contract to replace culvert

Approved an agreement with Douglas County for $6,000 out of a $50,000 total construction cost for replacement of a culvert on County Line Road, 0.05 miles south of 135th Street, utilizing Road, Bridge and Culvert CIP funds. Vote: Passed 7-0.

Contract for tower roof repairs

Authorized a contract with Delta Innovative Services, Inc. (IFB # 2022-067) for the Tower Roof Repair and Re-coating Project at the Adult Detention Center, 101 N. Kansas, Olathe, in the amount not to exceed $155,000. Vote: Passed 7-0.

Funding agreement with Lawrence for K-10 transit route

Approved a memorandum of agreement with the City of Lawrence, Kansas for funding from the City of Lawrence for the operation of the K-10 Connector transit route in the amount of $155,000 in FY2022 and $155,000 in FY2023. Vote: Passed 7-0.

Addition of modified pay plan to agenda

Approved the addition to the board’s action agenda pertaining to the naming of the steps for the Civil Service Pay Plan modification for 2022 and 2023. The addition was placed as the final agenda item. Vote: Passed 7-0.

Evergreen Living Innovations

Motion was made to table consideration of a proposed Early Termination Agreement between the Board of County Commissioners and Evergreen Living Innovation (ELI), Inc., with a payment of $29 million of General Fund Reserves (Countywide Support Funds) and directed staff to implement a process to receive and evaluate viable proposals for the board’s consideration before the board shall act upon an Early Termination Agreement with ELI, Inc. Vote: Passed 7-0.

Update to Solid Waste Management Plan

Approved the 2022 annual update to the Johnson County Solid Waste Management Plan as an amendment providing progress to the Solid Waste Management Plan, 2019 edition. Vote: Passed 7-0.

Contract with Leawood for mental health services

Authorized Mental Health staff to contract with the City of Leawood to provide the City mental health diversion services. Vote: Passed 7-0.

Contract to replace overhead rolling doors

Authorized a contract with DH Pace Company, Inc. to remove the existing overhead rolling doors and replace with exterior coiling doors on the Phase I Recreation Areas of the New Century Adult Detention Center, 27745 W. 159th Street, New Century, in the amount not to exceed $155,998 (Invitation for Bid (IFB) #2022-068). Vote: Passed 7-0.

Funding and contract for floodplain mapping project

Accepted the FEMA Cooperating Technical Partners Grant Award (RFP No. 2022-060) in the amount of $863,300 and authorized a contract with Stantec to complete the Turkey and Brush Creek Two-Dimensional Floodplain Modeling and Mapping project in an amount not to exceed $1,014,953. Vote: Passed 7-0.

Modification to Civil Service pay plans

Adopted Resolution No. 082-22 modifying the Fiscal Year (FY) 2022 and FY 2023 Budget Resolution (No. 077-22) and approved modified 2022 and 2023 Civil Service pay plans for the Sheriff’s Office to adjust the naming convention for steps to simplify administration of the plans. Vote: Passed 7-0.

JoCo Academy Update

During the Spring of 2020, JoCo Academy, a community-minded program that allows residents to discover county operations through behind-the-scene tours, hands-on activities, and conversations with county elected officials and staff, was suspended in response to the COVID19 pandemic. At the time of suspension, participants were halfway through their Spring program. A Fall makeup session began Tuesday, Oct. 4, to allow those participants the opportunity to complete their experience. Sessions will continue every consecutive Tuesday evening until Tuesday, Nov. 1. Participants will engage in presentations from various departments such as Wastewater, Planning, AIMS, Airport, and Emergency Services. Plans are also underway to return the full program in early 2023 with registration beginning in early December.

Property tax abatement in Overland Park

The City of Overland Park conducted a public hearing on Monday, Oct. 3, to consider approving a property tax abatement for Bluhawk Sports Properties, LLC. The proposed project is to be financed with $113,500,000 in economic development revenue bonds for acquiring, constructing, equipping and furnishing a multi-sport athletic complex to be located at approximately the southeast corner of 162nd Street and Lowell Avenue. The applicant has requested a 10-year tax abatement, with a fixed PILOT of $700,000 for years 1-5 and an increase to $750,000 for years 6-10. View a copy of the resolution and notice.

Other Reports

Board received a report on major projects over $1 million and master plans. The report is provided bimonthly and supplements the Public Building Commission biannual reports in February and August. The information contained in this report is through Sept. 30, 2022. View a copy of the report.

Items on the Agenda for Oct. 13, 2022

Revised final plat for lots

Application No. SE 22-236-FP (AU). Consider a request from Jake Hattock, Schlagel Engineering, applicant, on behalf of Scott and Kelli Adam, landowners, for a Revised Final Plat for Lots 11 and 12 of Adams Farm Estates, located near the southwest corner of 199th Street and Antioch Road.

Requests for rezoning and plat

Resolution No. 054-22. Application Nos. SE 22-211-REZ and SE 22-212-PDP (AU). Consider a request from Payne and Brockway, P.A., applicant, and Husam Kayyali and Yaser M. Mounla landowners, for rezoning 68.6 acres from Rural District (RUR) to Planned Residential Neighborhood 2 District (PRN-2) and a Preliminary Development Plan, which serves as the preliminary plat for 25 residential lots to be known as Blue Valley Reserves, located one-half mile south of 199th Street, on the west side of Mission Road.

PHA Plan to HUD

Conduct a public hearing and consider approving the proposed 2023 Streamlined Annual Public Housing Authority (PHA) Plan for submission to the United States Department of Housing and Urban Development (HUD).

Amendment to CIP

Resolution No. 078-22. Consider adopting Resolution No. 078-22 to Amend FY 2022- 2026 Capital Improvement Plan (CIP) to amend existing capital project for the New Century AirCenter Runway 18-36 Mill and Overlay and phase one of the Rehabilitation of Taxiway K to include Seal and Rejuvenate Runway 4-22 and to move existing capital project for Executive Airport, Reconstruct Taxiway F into FY 2022 in an amount not to exceed $851,740.

Amendment to contract

Consider authorizing a contract amendment with McCarthy Building Companies, Inc., for Guaranteed Maximum Price Number 2 – Turkey Creek Forcemain Installation and I-35 Traffic Signals, for Construction Manager at Risk construction phase services for the Nelson Wastewater Treatment Facility Improvements project (NEL-C001) in an amount not to exceed $3,629,098 increasing the total construction phase services authorization to $6,055,808; and consider authorizing a contract amendment with Black & Veatch Corporation for final design and Guaranteed Maximum Price Number 2 construction phase services, in an amount not to exceed $22,673,000, increasing the total design authorization to $37,973,000.

Early start dates for projects

Consider authorizing a Fiscal Year (FY) 2022 start date for the FY 2023 approved 1.0 FTE Sheriff Administrative Assistant, New Human Services Building Capital Improvement Project (CIP), Fleet Maintenance Building Expansion Project (CIP), Crime Lab HVAC Modifications Project (CIP), and Mental Health The Recovery Place (TRP) Building Modifications Project (CIP); and authorize the reallocation and expenditure of reserves for FY 2022 in the amount of $350,000 from the Public Health Fund, $992,010 from the Mental Health Fund, and $4,009,000 from the General Fund.

Contracts for furniture

IFB # 2022-063, Consider authorizing contracts with multiple suppliers for the purchase of furniture and services, in the amount not to exceed $3,000,000 for a period of one (1) year, with the option to renew with four (4) additional one (1) year periods.

2023 meeting calendar for BOCC

Resolution No.080-22. Consider setting an official meeting calendar for the Board of County Commissioners for 2023.
