A diagnosis of intellectually disabled made by a healthcare professional that is licensed to make a DSM-5 diagnosis.  Intellectual Disability is defined as:

• A substantial limitation in present functioning;
• Which manifests during the period from birth to 18 years of age;
• Is characterized by significant sub-average intellectual functioning existing concurrently with deficits in adaptive behavior including related limitations in two or more of the following applicable adaptive skill areas:
  • Communication
  • Self-care
  • Home living
  • Social skills
  • Community use
  • Self-direction
  • Health and safety
  • Functional academics
  • Leisure
  • Work

Developmental Disability does not include individuals who are solely severely emotionally disturbed or seriously and persistently mentally ill or have disabilities solely as a result of infirmities of aging.   Developmental Disability is defined as:

• Is a severe, chronic physical or mental impairment or a condition which has received a dual diagnosis of intellectual disability and mental illness; and
• Is attributable to a mental or physical impairment or a combination of physical and mental impairments; and
• Manifests before the age of 22; and
• Is likely to continue indefinitely; and
• Results in substantial functional limitations in three or more of the following areas of life functioning; and
  • Self-care
  • Understanding and use of language
  • Learning and adapting
  • Mobility
  • Self-direction in setting goals and undertaking activities to accomplish those goals
  • Living independently
  • Economic self-sufficiency
• Reflects a need for a combination and sequence of special, interdisciplinary or generic care, treatment or other services, which are life-long, or extended in duration and are individually planned and coordinated.

A child with a developmental disability applies to children under the age of six and includes the following criteria:

• Is attributable to a mental or physical impairment or a combination of mental and physical impairments; and
• Is likely to continue indefinitely; and
• Results in at least three (3) developmental delays as measured by qualified professionals using appropriate diagnostic instruments or procedures and
• Reflects a need for a combination and sequence of special, interdisciplinary or generic care, treatment, or other services which are lifelong or extended in duration and are individually planned and coordinated; and
• Does not include individuals who are solely severely emotionally disturbed or seriously and persistently mentally ill.
